SCHEDULE OF HEARINGS

Once a hearing is defined (which involves assigning hearing defaults such as the chamber, location - section/room -, formation, start time of the hearing, start time of the summonses), the hearing is planned by day and month over the year using a schedule.

You may access the hearing schedules of each Commercial Court after selecting the desired court.

Our suggestion : to speed up selection of the Commercial Court from the list, you may enter the first letter of the name of the court.

These schedules are updated by many Commercial Courts and may be viewed at www.greffes.com or on the website of the Commercial Court selected. The link � Schedule of hearings ï¿½ allows you to open a new browser window and display this schedule. You can return to the www.infogreffe.fr site by pressing the � Back to Infogreffe home ï¿½.

Judicial information can only be accessed for Commercial Court Registries.

As a result, information from the Tribunaux d'Instance (TI) and Tribunaux de Grande Instance (TGI - high civil court) which hear commercial cases, as well as the overseas départements and territories, is not available on the Infogreffe website.

CASE INQUIRY

You wish to view the details and history of a case and order the judgment if the case has been decided (or the court order if one has been rendered for a summary procedure).

You may search for this case or a list of cases.

The � Case inquiry ï¿½ link opens the page for entering the search criteria.

This feature is mainly limited to subscribers. However, ordinary users or members can view a case if they know the Commercial Court and number of the case they wish to view.

Which Commercial Courts may be accessed ?

Some Commercial Courts cannot be accessed through this type of search.
You can view the list of accessible Commercial Courts on the drop-down list displayed on the page for entering search criteria.

Select search criteria

The available criteria are as follows :

  • Commercial Court (required criterion). The accessible Commercial Courts are displayed in a drop-down list.
  • Both parties (required criterion for a subscriber) : you must enter the name of one claimant and the name of one defendant.
  • The case number (docket no.) (optional criterion for a subscriber and required for a member or the general public). If this criterion is entered, all other criteria already entered are ignored.
  • Hearing date or, if unavailable, a period (optional criterion). This can be the date of enrolment of the case, a date of referral, adjournment for consultation or a prior date for follow-up of cases.
  • The type of procedure selected from the following three types: Proceeding on the Merits, Summary Procedures, Collective actions (optional criterion).

Once the required criteria have been selected (and certain optional criteria to narrow the search), you must begin the search to obtain the search results.

The search will be performed only on pending cases and cases deregistered or decided within the last 6 months if the search concerns only the court and the name of one of the parties.
If you narrow the search by entering a hearing date or a search period, the search will include all pending cases and cases decided or deregistered as of that date or during that period.

Search results

For each case found, the following information is displayed in the result list:

  • The case name is displayed in the form first claimant/first defendant. By selecting this link, you can access the details about this case.
  • The docket number (case number) along with the type of procedure.
  • The parties' representatives: the first representative/attorney of the first claimant and/or of the first defendant.
  • The date of the next hearing in case of an enrolment, and the date of referral or adjournment for consultation in all other cases.
  • The word � decided ï¿½ is displayed if the case is completed. In this case, you may order the court order for a summary procedure or otherwise the judgment. The window for selecting the distribution medium is displayed: you must select the medium and add the document to your selection.

By default, the list of cases found is sorted by the next hearing date (chronologically) and then by docket number. Cases already decided therefore appear at the end of the list.

You may also sort the cases by type of procedure/docket number, next hearing date (in reverse chronological order)/docket number.

From this list, you may :

  • Modify the search by returning to the criteria entry page using the � Narrow search � link or the � Search � link in the breadcrumb.
  • Perform a new search using the � New search � link.
  • Print each page.

The maximum number of cases displayed is 100. Beyond 100 cases, the list cannot be displayed online. You can narrow your search by adding selection criteria to reduce the number of cases found.

Details of a case

The following information is displayed for the case selected :

  • Claimants and defendants, along with their respective attorneys.
  • Status of the case.
  • Type of proceeding initiated (on the merits, summary procedure, collective action).
  • Date of enrolment.
  • The date of the next hearing, the date of adjournment for consultation or the date of judgment.
  • Information on the status of the case which varies depending on whether or not the case has been decided (see details of decided cases, details of cases not yet decided below).

From this page, you may :

  • View history of the case.
  • Access the details of the other cases included in the search result list by using the � Previous case � and � Next case � links.
  • Print this page.
  • Modify the search by returning to the criteria entry page using the � Narrow search � link or the � Search � link in the breadcrumb.
  • Return to the list of cases using the � results � link in the breadcrumb.
  • Perform a new search using the � New search � link.
  • Set up a free alert on the claimant(s) or defendant(s). If you click on the name of the party that you wish to monitor, you will automatically be redirected to the identity record of that company. This identity record contains a � Set up a free alert � link which opens the popup for selecting the areas to monitor.

Details of a case not yet decided

  • Since the case has not yet been decided, the information concerning the hearing (date, chamber, time) is displayed. The words � Adjournment for consultation  ï¿½, � Simple referral  ï¿½ or � Referral for presentation of submissions ï¿½ are displayed based on the decision taken, followed by information about the reconvened hearing.
  • If the case was referred to a judge, information concerning the judge(name of the juge chargé d'instruire l'affaire, time of summons) is displayed.
  • If the case in being appealed, the date of appeal and the date of the appeals court's judgment are indicated in the details of the case.
  • If the case is being evaluated by an expert with the involvement of technicians, the type of pending measure (expert opinion, consultation, affidavit), deadline of the expert report, extension date for filing the expert report and information concerning the technician(s) involved in the case (name, address, phone number) will be displayed.

Details of a case already decided

  • Information concerning the hearing is no longer displayed since the case has been decided. Only the word "Decided", the date and type of judgment and the judgment itself are displayed. If the case was completed following a deregistration, the reason for deregistration is indicated.

Case history

The complete history of the case is displayed along with the following information : date of the decision, decision followed by any information available about the decision (for example, the object of the referral) and the next hearing date.

By default, this history is sorted in reverse chronological order. You may also sort this history chronologically or by decision.

From this page, you can :

  • Print the list of decisions.
  • Order or view the judgments or summary orders. The window for selecting the transmission method is displayed: you must select the medium and add it to your selection.

Which Commercial Courts may be accessed ?

The accessible Commercial Courts are the same as the Courts found in the case search.

Select search criteria

The available criteria are the same as the criteria for the case search.

The search includes all decided cases for which the judgment or court order (for summary procedures) may be ordered.

All decided cases will be searched.

Display of the case result list

The result list has the same format as the case result list.

Price of the judgment/court order

The price charged is 2,02€ excluding tax (or 2,42€ including tax) per judgment/court order plus mailing costs if the product is ordered by mail : 2€ excluding tax.
